Investigation of the Austrian competition authority into the market for liquid petroleum gas. We advised Austrian retailers of liquid petroleum gas (LPG) in an investigation of the Austrian competition authority. The investigation focussed on contracts that tied the delivery of liquid gas to the acquisition of a gas tank. We argued inter alia that these tying contracts made it necessary to define a market for energy systems (i.e. including the acquisition of both the tanks and the gas) rather than a separate market for gas delivery. Moreover, we argued that the bundling of gas tanks and gas delivery enabled several efficiencies that could not be ignored in the assessment.
