Cartels, damages and litigation

E.CA staff worked on many cases expanding the toolbox of empirical methods for damage calculation, cartel analysis and litigation:

  • We have worked both for the plaintiffs and defendants, as well as independently appointed court experts. We have provided overcharge estimates for settlement negotiations with national enforcement agencies and in private litigation.
  • In the widely observed German Cement case, we implemented empirical methods for estimating the overcharge caused by the cartel on behalf of the German cartel court
  • We are familiar with the litigation of private damages and the development of a pass-on defence. We worked on cartel detection methods and tools for assessing whether a relevant market is affected by a cartel or can serve as a comparator market.
